1. Legal notice and terms of use

1.1. Owner identification
In compliance with article 10 of Spanish Law 34/2002 on information society services and electronic commerce (LSSI-CE), the owner of the bitpulse.digital domain and the party responsible for the application is Juan Manuel Serrato Bou, tax ID 43549473P, domiciled in Spain for notification purposes (hereinafter, "BitPulse"). Contact: legal@bitpulse.digital.
1.2. What BitPulse is, and what it is not
BitPulse is an educational tool. It publishes a statistical model that projects the price of Bitcoin, for informational and educational purposes, and a personal notebook where you record your own decisions so you can review them later. Nothing else.
BitPulse does not provide investment advice, does not issue personalised recommendations, does not manage portfolios, does not receive or hold funds or crypto-assets, does not execute or transmit orders, does not act as an intermediary for any provider and receives no commission from third-party transactions.
1.3. Intellectual and industrial property
BitPulse owns all intellectual and industrial property rights over the contents, design, methodology and source code of the application. It also asserts the sui generis database right (articles 133 et seq. of the Spanish Intellectual Property Act), given the substantial investment made in obtaining, verifying and presenting its contents.
Automated data extraction
Accessing the site implies accepting the prohibition on extracting or re-using all or a substantial part of the contents of its databases, by any means and in any form, including automated collection (scraping) and use for model training. This condition is established contractually, in line with the doctrine of case C-30/14 Ryanair v. PR Aviation.
1.4. Account terms of use
Minimum age: the service is intended exclusively for people over 18. Accuracy: you undertake to provide truthful data and to keep your credentials confidential. Personal use: the account is personal and non-transferable. Prohibited uses: you may not use the service for unlawful activities, resell or redistribute its contents, present them as your own or as investment advice to third parties, or interfere with its operation.
1.5. Availability and limitation of liability
The service is provided "as is" and without any guarantee of uninterrupted availability. BitPulse relies on third-party data sources and does not guarantee the accuracy, completeness or timeliness of the information they provide. To the fullest extent permitted by law, BitPulse is not liable for damages arising from the use of or inability to use the service, nor for the financial decisions you make. None of the above excludes liability that cannot be limited by law, including liability for wilful misconduct or for damage to life and physical integrity, nor does it affect the rights granted to consumers by consumer protection law.

1.7. Applicable law and dispute resolution
These terms are governed by Spanish law. For disputes with users who qualify as consumers, the courts of the consumer's domicile shall have jurisdiction, in accordance with the Spanish General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007). In all other cases, the parties submit to the courts of Spain. The European Commission provides consumers with an online dispute resolution platform at ec.europa.eu/consumers/odr.
2. Privacy policy

This information is provided in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Data Protection and the guarantee of digital rights (LOPDGDD).
2.1. Data controller

No investment profile is created. The projection is identical for every user: it is computed once a day on the server and is not personalised with your data. There are therefore no automated decisions producing legal or similarly significant effects within the meaning of article 22 of the GDPR.
2.3. Processors
The following providers are used to deliver the service, each under an article 28 GDPR processing agreement: Auth0/Okta (authentication), Vercel (hosting and visit measurement), Supabase (database), Stripe (payments), Resend (email delivery) and Google Ireland Ltd. (Google Analytics, site usage measurement). The market data providers queried by the engine receive requests from the server and no personal data of users.
2.4. International transfers
Some of these providers process data on servers located in the United States; this includes Google Analytics, whose measurement is sent to Google infrastructure. Those transfers rely on the EU-US Data Privacy Framework where the provider is certified, and on Standard Contractual Clauses approved by the European Commission together with any necessary supplementary measures.
2.5. Your rights and how to exercise them
You may exercise your rights of access, rectification, erasure, restriction, objection and portability, and withdraw your consent at any time without affecting the lawfulness of processing carried out beforehand. From your account settings you can download your data in structured JSON format and request account deletion; you can also write to legal@bitpulse.digital. Requests are answered within one month.
2.6. Complaint to the supervisory authority
If you believe the processing of your data infringes the regulation, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es, C/ Jorge Juan 6, 28001 Madrid).
2.7. Security and minors
Appropriate technical and organisational measures are applied, including encryption in transit, access control and minimisation of the data collected: BitPulse never asks for or stores asset data, balances, positions or exchange or bank credentials. The service is not aimed at people under 18; any account found to belong to a minor will be deleted.
4. Financial disclaimer

High-risk product
Investing in crypto-assets is not regulated as a traditional investment product, may not be suitable for retail investors, and you could lose the entire amount invested. Crypto-assets are not covered by the Spanish Deposit Guarantee Fund or by FOGAIN. Their price is extremely volatile and can fall rapidly and without warning.
4.1. Nature of the content
All BitPulse content, projections, zones, alerts, scoreboards and explanatory text, is strictly educational and informational. It shows the output of a statistical model and the methodology behind it, so that anyone can understand how such a model behaves and publicly check where it fails.
Under article 4.1.4 of Directive 2014/65/EU (MiFID II) and article 140 of the Spanish Securities Market Act, investment advice exists when a personalised recommendation is made to a specific client regarding a specific instrument. BitPulse makes no personalised recommendations: the content is identical for every user, no profile is built, your financial circumstances are neither known nor requested, and at no point are you told what to buy, sell or hold.
4.2. Services not provided (MiCA)
For the purposes of Regulation (EU) 2023/1114 on markets in crypto-assets (MiCA), BitPulse provides no crypto-asset service: it does not hold or administer crypto-assets on behalf of third parties, does not operate a trading platform, does not exchange crypto-assets for funds or for other crypto-assets, does not execute, receive or transmit orders, does not place crypto-assets, does not manage portfolios and does not advise on crypto-assets. BitPulse also does not issue, promote or market any crypto-asset.
4.3. About the figures you will see
No figure in this application is a promise of return. It is worth understanding what each one is:
• The projections are probability bands generated by a statistical model from historical data. The market may behave very differently from any projection.
• Band coverage and hit rate measure the behaviour of the model, not a financial return. They are computed from historical validation and from published projections, and do not anticipate future results.
• "My plan" results are hypothetical and simulated: they describe what would have happened had you executed the decision you noted down yourself, computed on daily closing prices. They do not reflect real transactions, do not include fees, spreads, slippage, taxes or liquidity effects, and do not represent a return obtained or obtainable.
• Past results do not guarantee future results.
4.4. Responsibility for decisions
Any investment or divestment decision is the sole responsibility of the user, who makes it on their own judgement and at their own risk. You are advised not to invest amounts you cannot afford to lose, and to consult a financial adviser duly registered with the CNMV before making significant decisions. BitPulse does not provide tax advice: the taxation of crypto-assets depends on each taxpayer's personal circumstances.
4.5. No intermediation
BitPulse does not act as an intermediary, broker, agent or distributor. It does not execute orders, does not receive or hold user funds or crypto-assets, has no commercial relationship with exchanges and receives no remuneration linked to any transaction you decide to make. The only source of revenue for the service is its subscriptions.
4.6. Crypto-asset advertising
BitPulse does not carry out advertising activity about specific crypto-assets as investment objects, nor does it offer incentives to acquire them, so it falls outside the scope of CNMV Circular 1/2022 on crypto-asset advertising. Should any such communication be made in the future, the warnings and statements required by that rule will be included.
4.7. A dynamic projection, not a snapshot
The BitPulse projection is a probabilistic calculation recalculated every day with the latest data, expressed in price and date ranges, never exact values. It is not a snapshot of what will happen: today’s output may differ from yesterday’s, and that variation is part of the method, not a flaw. Its purpose is to provide clarity and context, not to guide decisions.
My plan is a simulation notebook (paper trading): it lets you note what you would do and later check what would have happened, based on your own decisions. It executes no trades, moves no money, and its results are hypothetical, they are not real returns and not a recommendation. By using it you accept that the model can vary from one day to the next.
5. Terms of purchase

5.1. Plans and prices
BitPulse offers a free Basic plan, which only requires creating an account, and a paid Pro subscription with two billing options: monthly (€12/month) or annual (€97/year). The price is the same for every user on the same billing option. Prices are shown in euros with applicable VAT itemised before confirming the purchase, with no hidden charges. What each plan includes is published on the pricing page.
5.2. Purchase process and confirmation
Before you confirm the order, the total price including taxes and the renewal frequency are shown. Payment is processed through Stripe; BitPulse never stores your full card details. You will receive confirmation of the purchase and the invoice by email, on a durable medium.
5.3. Renewal and cancellation
The subscription renews automatically for equal periods unless cancelled. You can cancel at any time from your account settings or by writing to billing@bitpulse.digital: there is no minimum term and no penalty. Cancellation takes effect at the end of the period already billed, during which you keep your access. If a renewal charge cannot be completed, the account is immediately moved to the Basic plan: Pro features stop being shown, but your data is not deleted, your notes and history are preserved and shown in full again if you reactivate.
5.4. Right of withdrawal
As a consumer you have fourteen calendar days to withdraw from the contract without giving any reason, under article 102 of Royal Legislative Decree 1/2007. As this is digital content supplied immediately, if you ask to start using the paid plan within that period you will be asked for your express consent and your acknowledgement that, once fully performed, you lose the right of withdrawal (article 103.m). To withdraw, simply write to billing@bitpulse.digital; the refund is issued by the same payment method within fourteen days at most.
5.5. Changes to the service and to these terms
BitPulse may change the service and these terms for technical, legal or product reasons. Any substantial change affecting an active subscription will be communicated by email at least thirty days in advance, and you may cancel free of charge before it takes effect.
5.6. Complaints
You can send any complaint to legal@bitpulse.digital. Receipt will be acknowledged and a reply issued within one month at most. If you are not satisfied, you can turn to the European online dispute resolution platform (ec.europa.eu/consumers/odr) or to the consumer bodies of your region.
Frequently asked questions
Is BitPulse telling me what to do with my money?
No, and it cannot. BitPulse publishes the output of a statistical model (dated price zones) which is identical for every user. It does not know how much you hold, what you have bought, or what your situation is. Without that there can be no personalised recommendation, which is exactly what the regulation means by advice. The decision is entirely yours.
So what is it actually for?
Two things. One, understanding: seeing where a statistical model places the likely price of Bitcoin, by what method and with what margin of error, and checking in public whether it gets it right or wrong. Two, remembering: writing down what you decided and reviewing it later in cold blood, instead of reconstructing it from memory months afterwards.
What does the "hit rate" you publish mean?
It measures how often the real price ended up inside the central band the model had published beforehand, not a financial return. And the goal is not to be right 100% of the time: an honest central band is right about half the time. If it were right almost always, that would be because the bands are so wide they say nothing.
In "My plan" it tells me how much I would have made. Is that real money?
No. It is a hypothetical calculation on daily closing prices: what would have happened had you executed the decision you noted down yourself. There are no real transactions involved, and the calculation excludes fees, spreads, slippage and taxes. It is there to help you review your judgement, not to account for a result.
Do you hold my money or connect to my exchange?
No, never. BitPulse does not hold funds or crypto-assets, does not execute orders and does not connect to any exchange, wallet or bank. We also never ask for balances, positions or credentials: if anyone ever asks you for those in our name, it is not us.
How does the projection work?
Four independent models are checked against each other across fourteen data sources, and the result is simulated thousands of times to draw probability bands. It is computed once a day on the server (the same for everyone) and its weights are recalibrated weekly by measuring them against what actually happened. The methodology is explained in How it works, and the results, failures included, in Results.
How do I delete my account or download my data?
From your account settings you can download your data in JSON format and request account deletion. You can also write to legal@bitpulse.digital. Requests are handled within one month at most.
How do I stop receiving alerts?
From the alert settings you can choose which families and horizons you want, through which channel, and the hours you do not want to be disturbed. Every email also includes an unsubscribe link. Withdrawing consent is as easy as giving it.
Can I cancel the subscription and ask for a refund?
You can cancel whenever you like from your account, with no minimum term: you keep access until the end of the period already paid. In addition, as a consumer you have fourteen calendar days of withdrawal under the terms described in section 5.4. Write to billing@bitpulse.digital.
I lost money trading. Are you responsible?
No. BitPulse never told you to trade or how to do it: it publishes a model for educational purposes, whose hits and misses are on public display. Investment decisions are exclusively yours, and so are their consequences. If you need someone to assess your specific case, go to an adviser registered with the CNMV.
